General Terms and Conditions for Goods Orders from our Online Shop

§ 1 Scope of Application

For your online orders via our website, the following General Terms and Conditions of Chris Farrell Cosmetics GmbH, Wendelinusstr. 8, 77836 Rheinmünster, Germany (Phone: +49 (0) 7227/507-0, Email: CFC@Chris-Farrell.com) apply exclusively in the version valid at the time of the order. Any regulations deviating from these conditions shall only apply if they have been confirmed by us in writing.

§ 2 Conclusion of Contract

Our information regarding goods and prices during the ordering process is subject to change and non-binding. By placing an order, you submit a binding offer; this offer is accepted by us as soon as we assign an order number to the offer. Until this point, we reserve the right, in particular, to refrain from delivering the offered goods in the event of their unavailability. A claim for delivery of the goods only arises upon acceptance of the offer.
You may not pass on the password provided for the online shop to third parties. In the event of disclosure, you are also responsible for orders placed by the third party. You are liable for any orders placed with your password and any resulting claims.

§ 3 Delivery

(1) CHRIS FARRELL Cosmetics charges a flat shipping fee per order. You can find the current conditions in our shipping cost table. For cash on delivery (COD) payments, an additional fee will be charged, which the delivery person collects on-site. No further taxes or costs will be incurred.

(2) We are entitled to make partial deliveries. In the case of partial deliveries, we will, of course, bear the additional shipping costs incurred.

§ 4 Maturity and Payment, Retention of Title

(1) The purchase price becomes due at the latest upon delivery of the goods.

(2) Depending on the amount of your order, your customer account balance, and the results of the credit check mentioned in § 7, you will be offered a selection of the following payment methods: purchase on account (invoice), direct debit, credit card (American Express, Eurocard/Mastercard, VISA), advance payment, or cash on delivery. Unfortunately, Chris Farrell Cosmetics gift vouchers cannot be used or considered for internet purchases. Purchase on account is only available for registered customers of Chris Farrell Cosmetics GmbH. Please note that for foreign billing and/or delivery addresses, only payment by credit card is offered.

(3) If you fall into arrears with payment, we are entitled to charge default interest at a rate of 5% above the current base interest rate announced by the European Central Bank. However, you reserve the right to prove that no damage or lower damage has occurred.

(4) The delivered goods remain our property until full payment has been made.

§ 5 Claims for Defects (Warranty)

(1) Product images do not always have to match the appearance of the delivered products. In particular, changes in the appearance and equipment of the products may occur after range updates. Claims for defects do not exist insofar as the changes are reasonable for the customer.

(2) If the goods are defective, we will provide supplementary performance within a reasonable period, i.e., either a replacement delivery or rectification of the defects. If the supplementary performance chosen by you is only possible with disproportionate costs, we are entitled to perform in another form. The expenses required for supplementary performance will be borne by us. If supplementary performance fails, you have the right, at your option, to rescind the purchase contract or demand a reduction in the purchase price.

(3) Defective goods must be returned to us unless you have decided to reduce the purchase price.

(4) Claims for defects expire within 2 years from the time of delivery of the goods.

§ 6 Liability / Damages

Damages for breach of an obligation arising from the contractual relationship shall be paid under the statutory requirements and only in the case of intent or gross negligence. The same applies to claims for damages based on the Product Liability Act.

§ 7 Data Protection/Credit Check

Data necessary for business processing is stored. All personal data will, of course, be treated confidentially. We obtain information regarding your previous payment behavior from the Verband der Vereine Creditreform e.V., Hellersbergstr. 12, 41460 Neuss, Germany. Additionally, we obtain further credit information for payments by credit card.

§ 8 Right of Withdrawal

If the customer is a consumer, they are entitled to a right of withdrawal for contracts concluded exclusively using means of distance communication, such as letter, telephone, fax, email, or online, in accordance with the following cancellation policy:

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

by means of a clear declaration (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, but its use is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the notification concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. For this reimbursement, we will use the same means of payment that you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You shall bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

The right of withdrawal does not exist for the delivery of sealed goods which are not suitable for return due to health protection or hygiene reasons if their seal was removed after delivery.

§ 9 Miscellaneous

(1) German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) Complaints may be submitted to the address mentioned in § 1.

(3) Insofar as you have ordered corresponding products/articles from us in our online shop or by other means, we would take the liberty, unless you object, to send you current product information in connection with your purchased product/article in the future. An objection can be made at any time, e.g., by email (newsletter@chris-farrell.com).
